This is contained in the joint PDEA/DOH-FDA advisory signed by PDEA Director General Undersecretary Arturo G. Cacdac, Jr., and DOH Secretary and FDA Acting Director General Janette P. Loreto-Garin who was represented by Undersecretary Kenneth Hartigan-Go. The ceremonial signing was held on September 8, 2015 at the PDEA Activity Area, PDEA National Headquarters in Quezon City.

Hemp seed oil is obtained by pressing hemp seeds. Unrefined hemp oil is dark to clear light green in color, with a nutty flavor, while the refined hempseed oil is clear and colorless, with little flavor and lacks natural vitamins and antioxidants. The oil is manufactured from varieties of Cannabis Sativa that do not contain significant amounts of THC (Tetrahydrocannabinol), or cannabinoids, the psychoactive element present in the cannabis plant.

PDEA, DOH-FDA ISSUE ADVISORY AGAINST THE USE OF HEMPSEED OIL AND THEIR DERIVATIVES FROM MARIJUANA

The Philippine Drug Enforcement Agency (PDEA) joins the Food and Drug Administration (FDA) and the Department of Health (DOH) in prohibiting the purchase and use of hempseed oil products or their varieties and derivatives from cannabis or marijuana.

Hempseed oil has been found to have some limited use in industrial and commercial production such as textiles, foods, papers, body care products, personal hygiene products/cosmetics, detergents, plastics and building materials.

According to Section 2 of Republic Act 9165, or “The Comprehensive Dangerous Drugs Act of 2002”, “People with legitimate medical needs are not prevented from being treated with adequate amounts of appropriate medications, which include the use of dangerous drugs”.

Cannabidiol is the second most prevalent of the active ingredient of marijuana next to Tetrahydrocannabinol (THC)- the main psychoactive cannabinoid of marijuana which causes mind-altering and euphoric effects. THC is a dangerous drug included in the 1971 United Nations Single Convention on Psychotropic Substances.

Methods of consumption

There are four ways to consume CBD oil– inhalation, sublingual drops, ingestion and topical application.

PDEA Director General Aaron N Aquino reiterated the warning after the increased trafficking of CBD oil using the mail and parcel services was recorded. CBD oil is also openly sold in online shopping platforms in the country.

Since February 2019, a total of 792 milliliters and 621 grams of CBD (with THC) contained inside bottles, droppers, capsules, vape juice cartridges, and gummy candies, were intercepted following 14 incidents of mail and parcel interdiction operations in airports and seaports. Two consignees were also arrested as a result of the operations. The rest of the seized packages reflected senders with fictitious names, and were placed under investigation.

Recorded seizures

PDEA Director General Aaron Aquino said the agency has recorded an increased trafficking of CBD oil through mail and parcel services.

Section 2 of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002, however, states that “people with legitimate medical needs are not prevented from being treated with adequate amounts of appropriate medications, which include the use of dangerous drugs.”

Citing information from the World Health Organization, Aquino also said CBD does not exhibit any effect indicative of any abuse or dependence potential.

“While marijuana remains illegal, including for medical purposes, in the country, terminally-ill patients may apply for a special permit from the Food and Drugs Administration (FDA) for the compassionate use of CBD oil,” the PDEA chief said.

Aquino advised the public to surrender any products containing CBD to the nearest PDEA regional offices.
